
Bogucki lawyers seek dismissal for third time
Defence attorneys ask court to look into instructions given to grand jury about the nature of Barclays and HP’s relationship

Lawyers representing former Barclays currency trader Robert Bogucki have mounted a stern pushback against the US Department of Justice (DoJ), arguing the government has failed to learn it cannot bring fraud charges against someone based on a counterparty’s assumption that it is owed a fiduciary duty.
In recent weeks, attorneys at Kaplan Hecker & Fink and Clarence Dyer & Cohen have emboldened their efforts to have the case dismissed, after the Second Circuit Court of Appeals once more vacated
